Welcome to H264 Production! These terms and conditions outline the rules and regulations for using our website at https://h264production.ma. By accessing or using our website and services, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our website.
1. Acceptance of Terms
By accessing and using the H264 Production website, you confirm that you:
Are at least 18 years of age or have parental/guardian consent
Have the legal capacity to enter into binding contracts
Accept and agree to comply with these Terms and Conditions
Will use our services in accordance with all applicable laws
2. Services Provided
H264 Production provides professional wedding videography and photography services, including but not limited to:
Wedding ceremony and reception coverage
Pre-wedding and engagement photo/video sessions
Video editing and post-production services
Digital and physical delivery of final products
Additional services as agreed upon in individual contracts
Specific services, deliverables, timelines, and pricing will be detailed in individual service agreements with clients.
3. Booking and Reservations
3.1 Booking Process
To book our services, clients must:
Submit a booking inquiry through our website or contact us directly
Provide accurate event details (date, venue, duration, etc.)
Review and sign a service agreement
Pay the required deposit to secure the booking
3.2 Deposits and Payments
A non-refundable deposit of 30-50% is required to confirm your booking
The remaining balance is due 14 days before the event date
Accepted payment methods: Bank transfer, credit card, cash
Late payments may result in cancellation or additional fees
All prices are in MAD (Moroccan Dirham) unless otherwise stated
3.3 Date Availability
Event dates are secured only upon receipt of the signed contract and deposit payment. H264 Production reserves the right to offer services to other clients if payment is not received within the agreed timeframe.
4. Cancellation and Refund Policy
4.1 Client Cancellations
More than 90 days before event: Deposit forfeited, remaining balance refunded
30-90 days before event: 50% of total contract price forfeited
Less than 30 days before event: 100% of contract price forfeited (no refund)
Postponement: May be allowed subject to availability; deposit transferable to new date
4.2 H264 Production Cancellations
In the rare event that H264 Production must cancel your booking due to unforeseen circumstances (illness, emergency, equipment failure), we will:
Notify you as soon as possible
Attempt to provide a qualified replacement photographer/videographer
If no replacement is available, provide a full refund of all payments made
Our liability is limited to the refund of payments received
5. Client Responsibilities
Clients agree to:
Provide accurate and complete event information (timeline, location, contact details)
Inform H264 Production of any special requirements or requests in advance
Ensure venue permissions and access for photography/videography
Notify H264 Production of any restrictions at the venue (time limits, areas off-limits)
Ensure the safety of H264 Production's team and equipment
Provide meals and refreshments for crew during events exceeding 6 hours
Respect the professional judgment of H264 Production's team regarding creative decisions
6. Delivery and Timeline
6.1 Delivery Schedule
Preview/Sneak Peek: Within 7-14 days after the event
Final Photos: Within 4-6 weeks after the event
Final Video: Within 8-12 weeks after the event
Physical Products: Additional 2-4 weeks for albums, prints, USB drives
6.2 Delivery Method
Final deliverables will be provided via:
Private online gallery for digital downloads
USB drive or external hard drive (if included in package)
Physical albums or prints (if ordered)
Important: Clients are responsible for downloading and backing up their files within 90 days of delivery. After this period, H264 Production is not liable for any data loss.
7. Intellectual Property and Usage Rights
7.1 Copyright
All photographs, videos, and creative content produced by H264 Production remain the intellectual property and copyright of H264 Production. Clients receive a license to use the content as outlined below.
7.2 Client Usage Rights
Clients are granted a non-exclusive, perpetual license to:
Use images/videos for personal purposes
Share on personal social media accounts with credit to H264 Production
Print for personal use (gifts, home display)
Share with family and friends
7.3 Prohibited Uses
Without written permission, clients may NOT:
Use content for commercial purposes or profit
Sell, license, or distribute the content
Alter, edit, or modify the content (except cropping for social media)
Remove watermarks or credits from images/videos
Enter the content in competitions or contests
7.4 H264 Production Usage Rights
H264 Production reserves the right to use any content created for:
Portfolio and promotional purposes
Website and social media marketing
Print advertising and publications
Awards and competition entries
Clients who prefer their content not be used for promotional purposes must notify H264 Production in writing before the event.
8. Limitation of Liability
H264 Production will take every reasonable precaution to deliver high-quality services. However:
8.1 Equipment Failure
While we use professional backup equipment, in the unlikely event of complete equipment failure, catastrophic data loss, or acts of God, our liability is limited to a full refund of payments received.
8.2 Third-Party Issues
H264 Production is not responsible for:
Venue restrictions that limit photography/videography access
Poor lighting conditions at the venue
Guest interference or obstruction
Lack of cooperation from venue staff or other vendors
Weather conditions affecting outdoor shoots
8.3 Image/Video Limitations
We cannot guarantee that every moment will be captured, especially in uncontrolled environments. H264 Production will use professional judgment to capture the most important moments of your event.
8.4 Maximum Liability
In any case, H264 Production's total liability shall not exceed the total amount paid by the client for the services.
9. Force Majeure
H264 Production shall not be held liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to:
Natural disasters (earthquakes, floods, storms)
Pandemics or health emergencies
Government restrictions or regulations
War, terrorism, or civil unrest
Strikes or labor disputes
Acts of God
In such cases, we will work with clients to reschedule or provide appropriate alternatives.
10. Website Use and Cookies

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation and mediation before pursuing legal action.

For contracts already signed, the terms in effect at the time of booking will apply.

These Terms and Conditions, together with any individual service agreements and our Privacy Policy, constitute the entire agreement between you and H264 Production.
